6. User Content and Intellectual Property

6.1 Your Content Ownership

You retain all ownership rights to the images you upload. By uploading content, you represent and warrant that:

• You own or have the necessary rights to the content
• The content does not infringe any third-party intellectual property or privacy rights
• You have obtained all necessary permissions, releases, and consents
• The content complies with these Terms and applicable laws

6.2 License Grant to AI Pics

By uploading content, you grant AI Pics a worldwide, non-exclusive, royalty-free license to:

• Store, display, and distribute your content on the Platform
• Generate AI-powered metadata, descriptions, and tags for your content
• Create thumbnails and optimize images for platform performance
• Use your content for promotional purposes (with attribution)
• Allow other users to view and download your content based on your sharing settings

This license terminates when you delete your content, except for content that has been shared or downloaded by other users in accordance with the licensing terms.

6.3 Platform Intellectual Property

All aspects of the Platform, including but not limited to design, code, logos, trademarks, and proprietary features, are owned by AI Pics and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. Image Licensing

7.1 License Types

When you upload images, you can specify the license under which others may use them. Users downloading images must comply with the specified license terms. Common license types include:

7.2 License Restrictions

• Reject uploads that violate these Terms or applicable laws
• Remove content that infringes intellectual property rights
• Take action against accounts that violate our policies

However, we are not obligated to monitor User Content and are not responsible for content posted by users.

9. Copyright Infringement and DMCA

We respect intellectual property rights and expect our users to do the same. If you believe that content on our Platform infringes your copyright, please provide us with:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location on the Platform
• Your contact information (email, phone, address)

10.2 Content Accuracy

We do not warrant that:

• The Platform will be uninterrupted, timely, secure, or error-free
• User Content is accurate, reliable, or free from errors
• AI-generated metadata and descriptions are completely accurate
• The Platform will meet your specific requirements
• Any defects or errors will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI PICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM:

• Your use or inability to use the Platform
• Any User Content or conduct of third parties on the Platform
• Unauthorized access to or alteration of your transmissions or data
• Any other matter relating to the Platform

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless AI Pics, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

13. Termination

You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination, your right to use the Platform will immediately cease.

We may suspend or terminate your account at any time, with or without notice, if you:

• Engage in fraudulent or illegal activity
• Pose a security or legal risk to the Platform or other users
• Abuse or misuse the Platform

14.2 Binding Arbitration
